PLEASE READ THIS POLICY CAREFULLY TO UNDERSTAND OUR POLICIES AND PRACTICES REGARDING YOUR INFORMATION AND HOW WE WILL TREAT IT. IF YOU DO NOT AGREE WITH OUR POLICIES AND PRACTICES, YOUR CHOICE IS TO NOT USE OUR WEBSITES OR SERVICES. BY ACCESSING OR USING THIS WEBSITE, YOU AGREE TO THIS PRIVACY POLICY. 


Please note: as explained below, this Privacy Policy applies to both HundredX Causes1 (HXC) Feedback Providers and Enterprise Solutions Feedback Providers2 , as defined below, notwithstanding the different user experiences with respect to those HundredX businesses, including the different ways in which those HundredX businesses may solicit, may collect, and may use data. To better understand this distinction, please see “What is HundredX’s business” and “To whom does this Privacy Policy apply,” below. This paragraph is intended to clarify the distinction between HundredX’s two primary businesses; however, nothing in this paragraph shall limit the application of this Privacy Policy with respect to other users, in addition to HXC Feedback Providers and Enterprise Solutions Feedback Providers.

THIS POLICY MAY CHANGE FROM TIME TO TIME (SEE “WILL HUNDREDX, INC. EVER CHANGE THIS POLICY?”). YOUR CONTINUED USE OF THIS WEBSITE AFTER WE MAKE CHANGES IS DEEMED TO BE ACCEPTANCE OF THOSE CHANGES, SO PLEASE CHECK THE POLICY PERIODICALLY FOR UPDATES.


Introduction


This Privacy Policy (“Privacy Policy”) describes the HundredX, Inc. (“HundredX” or “we” or “our”) privacy practices in connection with information that we collect through our websites at: www.HUNDREDX.com, www.HUNDREDXinc.com, and/or other sites or subdomains, and HundredX social media sites, as well as any mobile applications, software, and native applications (collectively, the “Websites”).


What is HundredX’s business?


There are several components to our business model:

Through our “HundredX Causes” or “HXC” programs (“Programs”), we align with charities, schools and other non-profits and cause-based organizations (“Causes”) to run feedback collection programs (e.g., over a 30-day period, or as otherwise prescribed) to obtain feedback from HXC Feedback Providers (defined below) on over 2,500 different companies, businesses, products, brands, services and organizations (“Feedback Subjects”), with each HXC Feedback Provider being able to submit feedback on multiple Feedback Subjects (e.g., up to 75 companies, or as otherwise prescribed) to generate a financial payment from HundredX to the Cause that HXC Feedback Provider is supporting, up to the total amount that HundredX has agreed to allocate to that Cause and/or that program. We aggregate and anonymize that feedback to provide products and services (including analytics and insights) to HundredX’s data clients (our “Data Clients”).


We also have an “Enterprise Solutions Business,” through which we offer listening platforms, solutions and services to HundredX clients that include companies, sports teams, universities, and other non-profits (“Enterprise Solutions Clients,” and, with the Data Clients, collectively, “HundredX Clients”). Enterprise Solutions Clients contract with HundredX to design, facilitate, and implement custom listening solutions and traditional surveys for targeted audiences (e.g., their employees, customers, alumni, etc.).


Whereas an HXC Feedback Provider must provide certain demographic information and may select from over 2,500 brands and business and submit up to 75 pieces of feedback during a 30-day period, an Enterprise Solutions Feedback Provider may not be prompted for or required to submit any demographic information and may simply be asked to complete a single custom survey on behalf of a specific Enterprise Solutions Client.


To whom does this Privacy Policy apply?

This Privacy policy applies to any of the following who access our Websites:

  • A person participating in an HXC Program by providing feedback on a Feedback Subject (an “HXC Feedback Provider”);
  • A person providing feedback in connection with our Enterprise Solutions Business (an “Enterprise Solutions Feedback Provider,” and, with the HXC Feedback Providers, collectively, “Feedback Providers”);
  • A HundredX Client;
  • A Cause;
  • Any other person accessing one of our Websites.

What Personal Information does HundredX collect?

“Personal Information” is information that identifies you as an individual or relates to an identifiable individual (e.g., name, address, telephone number, etc.). We collect Personal Information through the Websites, including:

  • Registration and/or demographic information: When you register as an HXC Feedback Provider, we ask you to provide account information (phone number, email address, and zip code) and may ask you a variety of other questions related to demographics and your consumer preferences. We may also follow up with you, as you participate in a Program (which generally lasts 30 days), to augment the information you provided at sign-up or to let us know if that information has changed. We may also ask (but not require) some Enterprise Solutions Feedback Providers to provide demographic information. HundredX Clients and others who register or create accounts with us may also be required to provide some of this information.
  • Feedback responses: HXC Feedback Providers give their views on the Feedback Subjects they choose to review, and Enterprise Solutions Feedback Providers give their views on Enterprise Solutions Clients or other matters. After you submit feedback in support of a Program, we may aggregate and/or anonymize Personal Information so that it will no longer be considered Personal Information within our organization. We do so to generate other data for our use, which (as discussed below) we may use and disclose for any purpose, as it no longer identifies you or any other individual.


Participation and Provision of Personal Information as an HXC Feedback Provider is voluntary.

When registering as an HXC Feedback Provider, you can always choose not to provide any Personal Information that we ask you for, other than email address and zip code, which, as a technical matter, we need in order to interact with you as an HXC Feedback Provider, and to promote data quality. If you do not want to provide your email address and zip code, you are not required to provide that information, but you will not be able to be a Feedback Provider without doing so.


Information you provide in the “Comments” section:


When you express your feedback, you have an opportunity to add text or verbatims, in your own words, that could include your opinions, positive or negative, about a Feedback Subject or Enterprise Solutions Client, as applicable, or a third party or an individual who works for or is affiliated with a Feedback Subject or Enterprise Solutions Client, as applicable, or another third party, or any other information you would like to provide. We may provide those comments, word for word, either in their entirety or in excerpted form, to our HundredX Clients. As such, please do not include any information in the comments section of our Websites that you would like to keep confidential, including sensitive Personal Information or material non-public or otherwise confidential or proprietary information about a Feedback Subject or Enterprise Solutions Client.


If you disclose any Personal Information relating to other people, or information relating to any Feedback Subject or Enterprise Solutions Client, to us or to our service providers in connection with the Websites, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy.


How does HundredX use your Personal Information?

  • To fulfill your requests: We may use your Personal Information to respond to your inquiries and fulfill your requests, such as when you contact us via one of our online contact forms. We may also use it to send administrative information to you, such as changes to our terms, conditions, and policies.
  • If you are an HXC Feedback provider, to send you feedback suggestions and facilitate social sharing: We may use your Personal Information to send you suggestions regarding Feedback Subjects that may interest you. For instance, if we are looking for feedback on a particular Feedback Subject from someone with your user profile to help round out our product offerings, we may ask you if you have experience with that Feedback Subject that you would like to share. We also use your Personal Information to facilitate social sharing that you choose to use.
  • To provide products and services to HundredX Clients: If you are a Feedback Provider, we may aggregate and/or anonymize Personal Information (e.g., by removing your name and email address, at a minimum, and combining your feedback with other reviews) so that it will no longer be considered Personal Information. We aggregate and/or anonymize feedback to provide products and services to HundredX Clients, and to generate other data for our use, which we may use and disclose for any purpose, as it no longer identifies you or any other individual. Furthermore, in our Enterprise Solutions Business, we sometimes ask you to choose whether you would like your feedback to be anonymous or confidential. If you do not elect for your feedback to be anonymous or confidential, then we may provide all of your feedback, and information about you, to the applicable Enterprise Solutions Client. 
  • To improve HXC, our Data Products, and our Enterprise Solutions Business: We internally use the Personal Information we receive to develop and improve the quality of our service; for example, to improve our user interfaces; to maintain a consistent and reliable user experience; and to help us and HundredX Clients evaluate the relevance and representativeness of your views.
  • If you are an HXC Feedback Provider, to help your feedback qualify under the HXC program: We make payments to Causes for qualifying feedback only, as reasonably determined by HundredX (“Eligible Feedback”), and up to the amount that HundredX has agreed to allocate to the specific Cause and/or program (e.g., $10,000).  To be clear, the total payment to a Cause, if any, may be capped by written agreement between HundredX and the Cause, and may include and/or cover Program related costs incurred by the Cause (including costs associated with any employee time to facilitate access to supporters), if any, which HundredX expects to be less than $500. Eligible Feedback will be deemed by HundredX to include all feedback on businesses and companies within the HundredX Feedback Universe excluding partial or incomplete feedback submissions and subject to common sense volume and quality restrictions covering individual Feedback Providers.  Feedback on the Program and suggested businesses to add in the future are also excluded from Eligible Feedback. We may use data about your feedback to determine whether your feedback meets these eligibility requirements. We may also provide you with prompts or notices to re-direct if you are providing ineligible feedback, although we cannot promise that we will do so.
  • To verify compliance and data quality: We may inspect and use techniques like machine learning on your feedback responses and Personal Information to ensure your compliance with our terms of use and to help ensure that the products and services we provide to HundredX Clients include quality data and insights.
  • To accomplish our business purposes. For example, we may use your Personal Information for data analysis or audit purposes, improving the Websites, addressing legal, regulatory, or contractual requirements, conducting fraud and security monitoring, or for operating and expanding our business activities.


How and when is your Personal Information disclosed to third parties?

We do not sell your email address, phone number, or name for third-party marketing.


  • To our third-party service providers. We may provide your Personal Information to companies that provide services to help us with our business activities such as website hosting, data analysis, information technology and related infrastructure provision, customer service, email delivery, auditing, and other services.
  • If you are an HXC Feedback Provider, to the Cause(s) you support. We build our relationship with HXC Feedback Providers through alignment with non-profits and other cause-based organizations who wish to use our HXC program to raise money. Those Causes often wish to recognize their supporters. We may disclose an HXC Feedback Provider’s Personal Information and feedback to the specific Cause that HXC Feedback Provider is supporting. An HXC Feedback Provider has an opportunity to opt-out at signup, if they do not want HundredX to share their name, contact information, and feedback count with that specific non-profit or cause-based organization. 
  •  In connection with a change in business ownership or structure. We may transfer your Personal Information to a successor entity upon a merger, consolidation, or other corporate reorganization in which HundredX participates, or in connection with another disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings).
  • When we have a legal obligation or legitimate interest. We may disclose your Personal Information as required or permitted by applicable law and regulations, including for purposes of national security and law enforcement, or when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, and/or to comply with a judicial proceeding, court order, subpoena, or other legal process served on us.
  • To HundredX Clients: If you are a Feedback Provider, we may aggregate and/or anonymize Personal Information so that it will no longer be considered Personal Information. For example, we may anonymize the feedback you provide by removing your name and email address, at a minimum, and/or aggregate it with other feedback, in order to provide products and services to HundredX Clients (e.g., if you are an HXC Feedback Provider, to Data Clients; and/or, if you are an Enterprise Solutions Feedback Provider, to Enterprise Solutions Clients). We may use and disclose aggregated and/or anonymized feedback for any purpose, as it no longer identifies you or any other individual.
  • Publicized Information. We or our HundredX Clients may disclose aggregated or anonymized information for marketing or other purposes.

Other Information.

“Other Information” is any information that does not reveal your specific identity or does not directly relate to an identifiable individual. We collect Other Information through the Websites in a variety of ways, including through:

  • Your browser or device. Certain information is collected by most browsers or automatically through your device, such as your Media Access Control (MAC) address, computer type (Windows or Mac), screen resolution, operating system name and version, device manufacturer and model, language, Internet browser type and version and the name and version of the Websites you are using.
  • Cookies. Cookies are pieces of information stored directly on the computer that you are using. Cookies allow us to collect information such as browser type, time spent on the Websites, pages visited, language preferences, and other traffic data. We and our service providers use the information for security purposes, to facilitate navigation, to display information more effectively, to personalize your experience, and to promote data integrity and feedback quality. We also gather statistical information about use of the Websites in order to continually improve their design and functionality, understand how they are used, and assist us with resolving questions regarding the Websites. We do not currently respond to browser do-not-track signals. If you do not want information collected through the use of cookies, most browsers allow you to automatically decline cookies or be given the choice of declining or accepting a particular cookie (or cookies) from a particular website. You may also wish to refer to http://www.allaboutcookies.org/manage-cookies/index.html . If, however, you do not accept cookies, you may experience some inconvenience in your use of the Websites.
  •  IP address. We receive your IP address from the device you use to access the Websites. We may also infer your geographic location based on your IP address.
  • Analytics. We use Google Analytics and other third-party analytics services , which uses cookies and similar technologies to collect and analyze information about use of the Websites and report on activities and trends. This service may also collect information regarding the use of other websites, apps, and online resources. You can learn about Google’s practices by going to www.google.com/policies/privacy/partners/, and you may exercise the opt-out provided by Google by downloading the Google Analytics opt-out browser add-on, available at https://tools.google.com/dlpage/gaoptout.


Uses and Disclosures of Other Information.

We may use and disclose Other Information for any purpose, except where we are required to do otherwise under applicable law. If we are required to treat Other Information as Personal Information under applicable law, we may use and disclose it for the purposes for which we use and disclose Personal Information as detailed in this Policy. In some instances, we may combine Other Information with Personal Information. If we do, we will treat the combined information as Personal Information as long as it is combined.


You can update your information. If you want to change or update your information, contact info@hundredxinc.com and we will be happy to help. We will respond to your request within a reasonable time and, where required by law or where we deem it otherwise appropriate and practicable to do so, we will honor your request.


Third-party services. This Privacy Policy does not address, and we are not responsible for, the privacy, information, or other practices of any third parties, including any third party operating any website or service to which the Websites link. The inclusion of a link on a Website does not imply our endorsement of the linked site or service.


Use of the Websites by minors. The Websites are not directed to individuals under the age of thirteen (13), and we do not knowingly collect Personal Information from individuals under 13.


Sensitive Information. Unless we request it, we ask that you not send us, and that you not disclose, any sensitive Personal Information (e.g., social security numbers, political opinions, religious or other beliefs, health, biometrics or genetic characteristics, or criminal background) on or through the Websites or otherwise to us.


Your California Privacy Rights. California Civil Code Section § 1798.83 permits users of our Websites that are California residents to request a notice identifying the categories of personal information that we share with our affiliates and/or third parties for their own marketing purposes and providing contact information for such affiliates and/or third parties. This request may be made no more than once per calendar year. Security. We use reasonable organizational, technical, and administrative measures designed to protect Personal Information within our organization. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure, please immediately notify us in accordance with the “Contact Us” section below.


Will HundredX, Inc. ever change this policy? The “LAST UPDATED” legend at the top of this Privacy Policy indicates when it was last revised. Any changes will become effective when we post the revised Privacy Policy on the Websites. We are constantly trying to improve our Websites, so we may need to change this policy from time to time as well.
